Highview Parking (part of GroupNexus) often fines drivers who enter a car park, can't find a space, and leave. This is predatory.

The "Consideration Period"

The BPA Code of Practice requires operators to allow a reasonable time for drivers to:

  • Read and understand the terms
  • Decide whether to accept the parking contract
  • Leave if they don't want to park

This is typically 5 minutes minimum.

When This Defense Applies

  • You entered, couldn't find a space, and left
  • You entered, saw the price, and decided not to park
  • You entered by mistake and immediately exited
  • You were in and out within 5-10 minutes

How to Appeal

"I entered the car park at [time] and exited at [time], a total of [X] minutes. This was within the consideration period allowed under the BPA Code. No contract was formed as I did not accept the terms by actually parking. The charge is therefore invalid."

Supporting Your Case

  • Calculate exact duration from ANPR times on your PCN
  • Explain why you left (no spaces, wrong location, etc.)
  • Reference BPA Code provisions on consideration periods

The "No Contract" Argument

A parking contract requires offer, acceptance, and consideration. If you never intended to park and left immediately, you arguably never accepted the offer.
